Introduction & Acceptance

By accessing or using our VPN and related services, provided by FUNDAMENTAL PROJECTS S.R.L. ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services. These Terms form a binding agreement between you ("User," "you," or "your") and FUNDAMENTAL PROJECTS S.R.L. These Terms include brief summaries for convenience, but the entire document is legally binding.

Service Description

We provide VPN and cybersecurity services designed to enhance your privacy by encrypting your data and anonymizing your internet activity. Our services are not intended to facilitate unlawful activities. You agree not to violate the laws of your country, the country where you use the service, or the laws of Romania.

We do not collect logs or any personally identifiable activity data as part of normal operations. However, to protect the service and comply with legal requirements, we may record anonymized technical metadata under certain conditions (see Data Protection & Privacy).

Account Registration and Security

• You may need to create an account to access certain features.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• You must not share your account, credentials, or access with third parties.
• You are responsible for all actions conducted under your account.

Payment, Packages, and Subscription Policy

• We offer two types of access: subscription plans and fixed-traffic packages.
• Traffic packages have no expiration date and remain available in your account until the included data volume is fully used.
• Subscription plans are billed on a recurring basis (e.g., every 30 days) according to your selected plan, unless cancelled in advance.
• You may cancel automatic subscription renewal at any time via your account dashboard or by contacting support at least 24 hours before renewal.
• Subscription auto-renewal purchased via app stores must be managed via the relevant store.
• No Refunds: All payments are final and non-refundable. By making a purchase, you agree that you will not receive a refund, either in full or in part, for any reason.

Service Availability & Limitations

• We strive to maintain continuous service but do not guarantee uninterrupted access.
• Actual speed, coverage, and service quality depend on various factors (e.g., device, network load, maintenance, force majeure).
• We are not liable for data loss, undelivered messages, outages, or network issues outside our control.
• We may suspend, restrict, or terminate access to protect our users, infrastructure, or comply with legal obligations.

Acceptable Use Policy

Strictly Prohibited Activities:

By using our services, you must NOT:

• Violate any law or regulation (including copyright and intellectual property).
• Engage in or facilitate hacking, unauthorized system access, or distribution of viruses.
• Transmit or store illegal, harmful, or offensive material.
• Use the service for web crawling, scraping, port scanning, spam, or unsolicited bulk messaging.
• Abuse, harass, or discriminate against other users.
• Attack, disrupt, or overload our infrastructure or third-party networks.
• Misrepresent your identity or impersonate others.
• Use the service for commercial resale (unless authorized).
• Attempt to bypass service restrictions or security.
• Exploit the system or service in any manner that is harmful or fraudulent.
• Use the service for non-personal or commercial purposes unless explicitly permitted.
• Use the service for any activities which could harm others or our reputation.

We reserve the right to investigate and block accounts engaging in any of the above, cooperate with authorities, and take any necessary action.

Intellectual Property

All software, branding, and content provided by us are protected by intellectual property laws and are licensed for personal, non-commercial use only.

Fair Usage

We enforce fair usage to ensure quality service for all users. Excessive, automated, or inappropriate usage may result in limits, suspension, or termination of your account.

Third-Party Services & Links

Our website and service may include links or integrations with third-party sites or resources. We are not responsible for third-party content, practices, or policies.

Disclaimer & Limitation of Liability

• Services are provided "as is" without warranty of any kind.
• We expressly disclaim all warranties (express, implied, statutory, or otherwise).
• We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our services.
• Some jurisdictions do not allow such exclusions; your rights may vary.

Data Protection & Privacy

We respect your privacy and process your personal data according to our Privacy Policy and applicable laws, including the EU General Data Protection Regulation (GDPR).

Logging and Data Storage

• As a Romanian company, we are not required to monitor or store your browsing activity, connection logs, or personally identifiable usage data.
• We do not routinely log user activity. However, to protect the service from abuse and comply with legal requirements, we may temporarily record anonymized technical metadata (such as connection timestamps and accessed server IPs).
• In rare cases—for example, upon a valid legal request from authorities investigating criminal activity—we reserve the right to identify, based on our internal records, which user account last accessed a particular resource or site, or what happened during a specific timeframe.
• All such data is stored in an anonymized and secure form and can only be accessed by the root administrator (business owner). Routine employees and third parties do not have access to this information.
• We do not store the content of your traffic or detailed logs about your online activities.

When We May Disclose Information

We only disclose user information to competent authorities in accordance with Romanian and EU law, and only in response to valid legal requests (such as a court order or warrant). No information will ever be sold or shared with third parties for commercial or marketing purposes.

Governing Law & Dispute Resolution

• These Terms are governed by the laws of Romania.
• Any disputes arising out of or relating to these Terms will be subject to the exclusive jurisdiction of Romanian courts at our registered address.
• Users outside Romania are responsible for compliance with their local laws.

Notices & Reporting Violations

To report illegal content or violations:

• Provide a detailed explanation, including what content is illegal, the location (URL), your contact details, and a good faith statement.

Modifications

We reserve the right to modify these Terms at any time. The latest version will be posted on our website with the effective date. Continued use of the service after changes indicates your acceptance.
